1. Purpose of the Agreement: The purpose of this Agreement is to outline the terms under which the Photographer will take and use photographs of the Subject for a photo exhibit aimed at promoting the abilities of people with disabilities.
2. Ownership of Photographs: The Subject acknowledges that all photographs taken by the Photographer are the sole property of the Photographer. The Photographer retains all rights to the images, including the right to use, reproduce, exhibit, and distribute the photographs at their discretion, in any media or format, whether now known or hereafter created, for any purpose.
3. Use of Photographs: The photographs may be used in various exhibits, publications, and promotional materials to support and promote the abilities of people with disabilities. The Photographer may also use the photographs for personal promotion, including but not limited to portfolios, social media, websites, and other marketing materials.
4. Compensation: In consideration for the Subject's participation and the rights granted under this Agreement, the Photographer agrees to provide the Subject with a custom photograph chosen by the Photographer. This photograph will be provided at no cost to the Subject.
5. Subject’s Release: The Subject hereby releases and discharges the Photographer from any and all claims, demands, or causes of action that the Subject may have arising from or relating to the use of the photographs, including any claims for libel, invasion of privacy, or violation of any right of publicity.
6. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of laws principles.
7. Entire Agreement: This Agreement contains the entire understanding between the parties concerning the subject matter hereof. Any modifications or amendments to this Agreement must be in writing and signed by both parties.
8. Signatures By signing below, the parties agree to the terms and conditions stated in this Agreement.
